The service of Mirbit.com dragz & Mirbit.com cardz (collectively, “Mirbit” or “the Service”) are operated by Mirbit Inc.  By accessing or using www.mirbit.com (the “Site”) you (the “User”) identify that you agree to be bound by these Terms of Use (“Terms of Use” or “Agreement”).  We reserve the right to change, modify, add, or delete portions of these Terms of Use at any time without further notice.  If you do not agree to these Terms of Use, do not use or access the Service or the Site.

This Service and Site are available to use for personal, non-commercial use only.  Should you want to use the Service for commercial purposes you must contact Mirbit and obtain appropriate permission to do so.

You agree that no materials of any kind uploaded to the Service will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain unlawful material.

You agree that you will not upload photographs of others, except where User has obtained express permission from such other person or entity in connection.

You agree NOT to use the site in the following manner:

• use the Service or the Site in an unlawful manner or in any other manner that could damage, disable or overstrain the Site;
• upload any content that we deem to be harmful, threatening, unlawful, infringing, abusive, harassing, vulgar, obscene, fraudulent, invasive or privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
• upload any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

The Site and the images are provided “as is”.  We offer no warranty, explicit or implied, regarding any images, the Site, the accuracy of any information under this agreement.  Mirbit does not represent or warrant that the Site or the images will meet your requirements or that their use will be uninterrupted or error free.

You agree to indemnify, defend, and hold harmless Mirbit and its officers, employees, shareholders and directors against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this Agreement, the use of this site and the use or the inability of use of any Image, your failure to abide by any restriction regarding the use of an Image, or any claim by a third party related to the use of an Image.
